1. Introduction
By accessing and using the dealer.cyrusher.com website, application, or services (collectively referred to as the "Site"), you ("User" or "Dealer") agree to be bound by this User Agreement ("Agreement"). This Agreement, along with the Privacy Policy, constitutes the legally binding terms governing your use of the Site, any membership you establish, and your purchase or use of products or services offered on the Site.

If you do not agree with all provisions of this Agreement, you must not access or use the Site, create an account, or purchase products or services.

2. Account Creation and Use of Site
A) Eligibility:

  • You must be at least 18 years old to register as a user.

  • By registering, you confirm that your use of the Site complies with all applicable laws in your jurisdiction.

B) Account Information:

  • You must provide accurate and complete information during registration, including your full name, current address, and a valid email address.

  • You are responsible for maintaining the confidentiality of your account and password. Any activity under your account is your responsibility.

  • You agree to notify Cyrusher immediately of any unauthorized use of your account.

C) Prohibited Activities:

  • You may not transmit any harmful programs, viruses, or destructive code.

  • You may not reproduce, duplicate, copy, sell, or exploit any portion of the Site without written permission from Cyrusher.

  • You must comply with all applicable laws and regulations in your jurisdiction.

D) Termination:
Cyrusher reserves the right to terminate your account or access to the Site at any time for violations of this Agreement or applicable laws.

3. Terms of Sale
A) Product Information:

  • Product details, pricing, and availability are subject to change without notice.

  • Cyrusher reserves the right to modify, suspend, or discontinue any product or Site feature at any time.

B) Order Acceptance:

  • Your receipt of an order confirmation does not signify acceptance of your order.

  • Cyrusher may cancel or decline any order for any reason, including but not limited to pricing errors or stock unavailability.

  • If your order is canceled after payment, a refund will be issued to your original payment method.

C) Shipping and Delivery:

  • Delivery dates are estimates only.

  • Cyrusher may deliver orders in installments.

  • You are responsible for import duties, taxes, and compliance with local regulations.

4. Returns and Refunds
A) General Return Policy:

  • Returns must be requested within 30 days of delivery.

  • Items must be unused, in original packaging, and in the same condition as received.

  • A 25% restocking fee may apply.

  • Shipping costs for returns are the dealer’s responsibility.

B) Non-Returnable Items:

  • Sale items, special orders, batteries, and wear-and-tear items are final sale and cannot be returned.

C) Damaged Items:

  • Report damaged items within 3 days of delivery. Provide photos and documentation for verification.

  • Cyrusher will issue a refund or replacement for verified damage.

5. Warranty Terms
A) Coverage:

  • 2-Year Limited Warranty: Covers the frame, motor, and controller against manufacturing defects.

  • 1-Year Limited Warranty: Covers batteries, brakes, fork, shock, and other components.

  • Exclusions: Normal wear and tear, consumables, and damage from misuse or unauthorized modifications.

B) Claims Process:

  • Submit warranty claims via the dealer portal or email to dealer@cyrusher.com.

  • Provide proof of purchase and evidence of the defect (e.g., photos, videos).

  • Cyrusher may require the return of defective parts for inspection.

C) Limitations:

  • Warranty is void for second owners or unauthorized repairs.

  • Cyrusher is not liable for shipping damage if the dealer uses their own shipping service.

6. Intellectual Property
A) User Submissions:

  • By submitting content (e.g., feedback, photos), you grant Cyrusher a perpetual, worldwide license to use, modify, and distribute the content.

  • You represent that you own or have the rights to any content you submit.

B) Cyrusher’s Intellectual Property:

  • The Site, its content, and Cyrusher’s trademarks are protected by intellectual property laws.

  • You may not use Cyrusher’s intellectual property without prior written permission.

7. Limitation of Liability

  • Cyrusher is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Site or products.

  • You agree to indemnify and hold Cyrusher harmless from any claims or damages resulting from your breach of this Agreement.

8. Dispute Resolution

  • Any disputes related to your use of the Site or products will be resolved through binding arbitration, not in court.

  • Arbitration will be conducted on an individual basis; class actions are not permitted.

9. General Terms
A) Changes to Agreement:

  • Cyrusher reserves the right to update or modify this Agreement at any time. Continued use of the Site constitutes acceptance of the revised terms.

B) Governing Law:

  • This Agreement is governed by the laws of Hong Kong.
